The ACHIEVE Act = possible W visa coming soon?

By: Harlan York

The GOP reportedly is set to propose a new W-1 visa, to allow an immigrant to attend college or serve in the military. Then the W visa holder could apply for a 4 year work visa and follow that status to apply for a green card. Citizenship could follow at the end.

W-1 eligibility under ACHEIVE would require:

  • 5 years of living in the US prior to the Act going into effect.
  • Entry before age 14
  • Good moral character
  • Knowledge of English, US history and government
  • Age 28 or younger at time of applying (or 32 if applicant has Bachelor’s Degree from US college)
  • $525 filing fee
  • Medical exam
  • Background check
  • Selective Service registration

This ACHEIVE idea is a starting point but I think will require some compromises, especially this rule on the age at entry.
